Will filed July 28, 1847

In the name of God, Amen. I, James Caldwell, of the Township of Sewickley, in
the County of Westmoreland, in the Commonwealth of Penna. being of sound mind,
memory, and understanding, considering the uncertainty of this life and being
desirous of getting in order my worldly business, do make and constitute this,
my last Will and Testament.
First, and principally, I desire to commend my soul to God, who gave it, and
my body to its native dust, nothing doubting but it will be raised up at the
last day, and as to the worldly goods which I have been entrusted with, I will
and direct as follows
First. I will and bequeath to my daughter, Sarah, all my personal estate of
whatsoever description and that without appraisement, and the privilege and
right of remaining and dwelling in the part of my house which I now occupy for
a term of seven years after my decease, and to have the privilege of keeping
one horse and one cow to pasturage, and to be kept in hay, if she shall live so
long single and unmarried, but she shall have no power to leave to another.
Also, I give and bequeath to my daughter, Sarah, six hundred dollars in money,
to be paid as herein after directed
Second. I give and devise to my son, William, all my real estate in fee,
subject to the payment of all my just debts and funeral expense, and the
payment of eleven hundred dollars in the following manner, that is to say: One
hundred and fifty dollars per year commencing one year after my decease, and he
shall pay my daughteer, Sarah,
First. I will and bequeath to my daughter, Jane, and her heirs fifty dollars to
be next paid
I will and bequeath to my daughter, Elizabeth, and her heirs fifty dollars next
paid
I will and bequeath to my daughter, Abigale fifty dollars next paid. I will and
bequeath to my daughter, Isabella, and her heirs, fifty dollars next paid I will
and bequeath to my daughter, Phoebe, and her heirs fifty dollars to be next paid
I will and bequeath to the two children of my deceast daughter, Polly, and to
their heirs, fifty dollars, share and share alike, next paid. I will and
bequeath to my son, Ebenezer, fifty dollars, to be next paid. I will and
bequeath to my son, Joseph, fifty dollars to be next paid. I will and bequeath
to the Session of Sewickley Church fifty dollars to be next paid for the entire
use of said church, and applied by the Session as they may deem proper
And I bequeath to the Home Missionary Society of the Presbyterian Church fifty
dollars to be the next, and last, payment out of my personal estate.
I will and bequeath to my son, William, my clock and rifle gun And lastly, I do
revoke all former wills by me made, and I do hereby constitute and appoint my
son, Ebenezer, and my friend, William Plummer, the executors of this, my last
will and testament, revoking all former wills by me made In witness whereof, I
have hereunto set my hand and seal this nineteenth day of June, A.D. 1846

Sealed, pronounced and declared in presence of us, who are requested to
subscribe in the presence of the teestator and in presence of each other as
witnesses Alexander Plummer and J.C. Plummer

Westmoreland County S.S. Before me, David Cook, Register of Wills, in and for
said County, formally came J.C. Plummer, one of the subscribing witnesses to
the foregoing written will of James Caldwell, deceased, who upon his solemn
oath doth depose and say that he was present at the execution of the same, and
saw the said testator sign his name at the end thereof, and heard him declare
it to be his last will and testament.- That at the time of so doing he
believing him of sound and disposing mind, memory, and understanding and that
he signed his name at the request and in his presence of the testator. Sworn and
subscribed the twenty third day of July A.D. 1847
